Подход, который применяется в сфере государственных закупок Кыргызстана, стремится активно способствовать конкуренции. В частности, часть 3 статьи 12 закона “О государственных закупках” устанавливает правила, согласно которым закупающая организация имеет возможность разделить однородные товары, работы или услуги на несколько лотов. Этот механизм предоставляет максимальные возможности для участия различных поставщиков и исполнителей, способствуя формированию конкурентной среды.
Более того, Порядок проведения электронных государственных закупок уточняет, что технические спецификации, разрабатываемые закупающей организацией, должны способствовать не только максимальной конкуренции, но и обеспечивать соответствие закупаемых товаров, работ или услуг установленным стандартам и требованиям. Важно отметить, что эти спецификации не могут иметь ограниченный характер, что подчеркивает необходимость предоставления равных возможностей для всех заинтересованных сторон.
Таким образом, законодательство нацелено на поддержание прозрачности, честности и эффективности государственных закупок в Кыргызстане путем создания условий для максимальной конкуренции, поэтому в случае объединения нескольких предметов в одни лот могут возникнуть обоснованные сомнения в законности закупочных процедур

DEPARTMENT OF STATE PROCUREMENTS
The Department is a state executive body of the Kyrgyz Republic, functioning in the status of a subordinate subdivision of the Ministry of Finance of the Kyrgyz Republic (hereinafter referred to as the Ministry), ensuring the regulation of the public procurement system
To implement the functions and tasks, the Department has the right to:
1) request and receive from state or municipal bodies, services, funds and enterprises, joint-stock companies and other bodies the necessary information on issues within its competence;
2) create temporary working groups to prepare proposals for improving the public procurement process;
3) organize and conduct events (meetings and seminars) in accordance with the established procedure on issues within the competence of the Department, with the involvement of representatives of the relevant ministries, the state committee, administrative departments, institutions and organizations;
4) participate in the development of projects and signing in the prescribed manner, in agreement with the Ministry, with the authorized state body in the field of foreign affairs, international treaties, agreements and other documents with foreign states and international organizations;
6) send materials about committed violations to the relevant law enforcement agencies;
7) send specialists on business trips and internships;
8) exercise other rights in accordance with the legislation of the Kyrgyz Republic.
